We charge less than the big box companies. We charge a percentage of the amount that we save you. This gives us more incentive to save you as much as possible. Our fees are paid in monthly payments as your creditor payments are made.
Q. How does Kirkpatrick & Associates, LLC debt settlement work?
A. Consumer has a credit card, repossession, charged off account etc. The balance may be $8,000. We will review the account for violations of The Fair Credit Reporting Act and the Fair Debt Collection Practices Act. Depending on our findings we may attempt to remove the account from consumer’s credit report. Otherwise, you will begin making payments into your Dedicated Account. (we will explain this when you call us).
Account will need to build up enough so that payments can be made monthly so that there are funds to make payment the enrolled accounts or to make 1 or more larger payments to satisfy debt. This is a customized plan and may slightly vary from client to client.
Our fees will be paid in monthly payments as your creditor payments are made. We also provide a CAP on how much we charge for those larger debts. Our goal is to treat each client fairly and assist in getting out of debt as quickly as possible all while educating and rebuilding credit.
Q. What are your charges for debt settlement?
A. We charge 20% of the amount that we save you. Example: Enrolled debt is $3,000. Settled for $2,000. We saved you $1,000. Our charges: $200 and can be made in payments.
There is a small one-time enrollment fee of $125. A small monthly fee of $15.00. We require the Legal Plan to be in place for $59 a month. This covers 100% of attorney fees. If your county requires filing fees, consumer is responsible for those fees. This plan covers 2 people for as long as you have the Legal Plan in force
Q. Will you repair my credit?
A. Yes, when you are finished with the program we will provide credit repair services on the accounts that we settled, at no charge. You will be required to continue your credit monitoring and the optional $15 month charge for ReScore Solutions to print and mail your letters.
Q. I am receiving phone calls from creditors and debt collectors. What can I do about these calls? I’m losing my mind.
A. Kirkpatrick & Associates, LLC will legally stop the calls and communication. We will direct them to direct all calls and correspondence to us. If you receive any contact afterwards you are to contact us.
Q. Does your company have attorney’s working on my accounts?
A. No. We are not a law firm nor do we have attorneys working on your file. We can legally negotiate your debt and coach you throughout the process without being a licensed attorney. We are educated in laws regarding debt, collections and reporting your debts. If we find violations we will put you in contact with an attorney in your area that specializes in this area of law. We network with two attorneys in Birmingham.
Q. Once your company negotiates an enrolled debt will I still have to pay you if I get sued?
A. Yes, because we have already performed the work of negotiating the debt our charges are still owed. But in the case of legal action and if the creditor requires you to pay more than the amount originally settled, we will adjust our fees so that you owe us less.

REPOSSESSIONS & CHARGE-OFF’S
We review your credit reports for inaccurate, unverifiable and outdated information regarding these type of accounts. While we have been successful many times in getting these accounts removed, many times these accounts have to be paid to get them cleared up, but we can assist you through the process working to get you the best settlement.
LATE PAYMENTS
Removing late payments are not always possible, but many times we have been successful. Keep in mind that when late payments are recent, in our experience getting them removed is most often not going to happen. Please be careful about doing business with a company that makes promises to clear up a 100% of your negative credit. There is no magic wand.
PUBLIC RECORDS: LIENS, JUDGMENTS, BANKRUPTCY
We are often successful in getting public records deleted from credit reports. We use the laws that are in place for successful deletions, but many times this can take many months.
Do keep in mind that having public records deleted from your credit reports does not delete them from public record files at government agency that it was filed, but it does help your credit scores. Once public records are deleted, you still owe them and need to make plans to pay any outstanding liens, judgments, or Chapter 13 bankruptcies. Please note that paying judgments and liens doesn’t get them removed from your credit reports. They can legally leave them on your credit report as “satisfied” and note the new payment status.

QUESTION: I am an Authorized User on my mother’s credit card. She lost her job and has not been able to pay and now the account has been sent to a debt collector. They are not only calling her, but they are also calling me. I feel that I don’t owe it but they continue to tell me that I need to pay it. This has already been reported as a charge-off on MY credit report. They are threatening to sue. How can this be taken care of without me paying something that I don’t owe?
